Terms of Service
Last updated: September 20, 2026
1. General
1.1. These Terms of Service (“Terms”) govern access to and use of pesenkaspeta.com and the services offered through it (together, the “Service”).
1.2. The Service is operated under the brand Pesenka Speta by Vladimir Vul (“we”, “us” or “Service Provider”).
1.3. By using the Service, submitting information for creation of a Song, accepting these Terms, or completing a purchase, you agree to these Terms.
1.4. If you do not agree to these Terms, you must not use the Service or place an order.
1.5. These Terms apply together with our Privacy Policy, Refund Policy, and any additional terms shown to you before purchase.
2. Definitions
Song means personalized digital musical content created through the Service, which may include music, vocals and lyrics.
Input means names, occasions, style preferences, wishes, descriptions, facts and other information submitted by a user.
Variant means one of the generated or prepared results based on the Input.
Order means the digital product or service selected by a user and presented before checkout.
Greeting Page means a shareable webpage containing a Song and related presentation elements.
Materials means Songs, lyrics, audio files, images, covers, Greeting Pages and other digital outputs made available through the Service.
3. How the Service works
3.1. The Service allows users to create personalized songs based on an occasion, musical style, recipient name and other Input.
3.2. The typical process may include:
- submitting a recipient name, occasion, style and personal details;
- creating one or more lyric and Song variants;
- previewing available results where previews are offered;
- selecting a result and completing payment; and
- receiving access to the purchased digital content, which may include a full Song, an MP3 file and a Greeting Page.
3.3. The exact number of attempts, lyric variants, Song variants, downloads and other deliverables is shown on the relevant product or order page before payment and forms part of that Order.
3.4. Unless expressly stated otherwise, the Service is an automated digital service and is not a custom recording studio involving a dedicated human vocalist, composer, producer or audio engineer.
4. Eligibility and access
4.1. You must be at least 18 years old, or the age of legal majority in your jurisdiction, to make a purchase. A minor may use the Service only with the permission and supervision of a parent or legal guardian.
4.2. You are responsible for keeping any private access link, email-based access method or other identifier secure.
4.3. You are responsible for providing accurate contact and order information.
5. Orders and creative output
5.1. You are responsible for reviewing your Input before starting creation.
5.2. Names, facts, dates, wishes and other Input may be adapted into a different artistic form to fit rhythm, rhyme, musical structure and the creative format of the Song.
5.3. Where a preview is available, you should review the available lyrics and audio before completing your purchase.
5.4. Purchasing a selected Variant confirms that you have chosen that available result for delivery in the purchased form, without limiting any mandatory consumer rights that apply to you.
6. Price, payment and Merchant of Record
6.1. The current price, currency, taxes where applicable, and the contents of the Order are displayed before checkout. Unless expressly stated otherwise before purchase, an Order is a one-time purchase and does not create a subscription or automatic renewal.
6.2. Prices for future Orders may change at any time. A price change does not alter an Order that has already been completed.
6.3. For purchases processed by the Merchant of Record, the Merchant of Record is the seller of record for the transaction and is responsible for payment processing, applicable transaction taxes, receipts or invoices, payment-related customer service and the execution of refunds in accordance with its buyer terms and applicable law.
6.4. Your purchase transaction is also subject to the buyer terms and privacy information presented by the Merchant of Record at checkout. These Terms govern your use of the Service and the license to the Materials provided by us.
6.5. We do not receive or store your full payment card details for transactions processed by the Merchant of Record.
7. Delivery of digital content
7.1. After successful payment, the Order may provide access to:
- the full version of the selected Song;
- an MP3 download;
- a Greeting Page, where included in the Order; and
- remaining attempts or variants, where included in the Order.
7.2. Digital content may be delivered through the website, a unique link, email or another method described during the purchase flow.
7.3. You should download and securely store any files you wish to keep. The Service is not intended to function as permanent cloud storage.
7.4. Where digital content is supplied immediately, you may be asked at checkout to consent to immediate performance. Depending on your jurisdiction, beginning immediate delivery may affect a statutory right of withdrawal. This does not waive any right that cannot legally be waived.
8. AI-assisted and automated output
8.1. The Service may use artificial intelligence and automated systems to create or process Materials.
8.2. To the extent permitted by applicable law, we do not guarantee:
- that every Material will be completely unique;
- perfect pronunciation of names, surnames, places or uncommon words;
- that creative output will match a user's subjective musical preferences;
- that every output will be free from stylistic, factual, linguistic or semantic inaccuracies; or
- that Materials are suitable for professional distribution, commercial release or rights registration.
8.3. You are responsible for reviewing Materials before publishing, distributing or otherwise using them.
8.4. Normal variation or imperfection in automated creative output is not by itself a technical failure where the purchased functionality and digital content were delivered as described, subject always to mandatory consumer rights.
9. Your Input and third-party rights
9.1. You retain any rights you already hold in the Input and materials you submit.
9.2. You grant us a limited, non-exclusive right to process the Input only as reasonably necessary to provide the Service, fulfill the Order, provide support, prevent abuse, maintain security and comply with legal obligations.
9.3. You represent and warrant that:
- you have the right to submit the Input and any uploaded materials;
- your use of the Service does not infringe copyright, privacy, publicity, image, voice, trademark or other third-party rights;
- you will not knowingly submit unlawful, defamatory or materially false content about another person;
- you have any consent required to submit personal information about another person; and
- you have all permissions required for any voice recording, likeness, image or other identifying material you ask the Service to process.
10. Rights to the Materials
10.1. After full payment, and subject to these Terms and any third-party rights, we grant you a worldwide, non-exclusive, non-transferable, perpetual license to use the delivered Materials for personal, non-commercial purposes.
10.2. This license allows you to:
- download and store the Song;
- send it to family members, friends, colleagues or the intended recipient;
- share the Song or Greeting Page through personal social media accounts and messaging services; and
- play the Song at private events.
10.3. Unless a separate commercial license is expressly included with the Order, you may not sell, sublicense, commercially exploit, register for monetization, distribute through commercial music catalogs, or use the Materials in paid advertising without our prior written permission.
10.4. The copyright status and protectability of AI-assisted or automatically generated content differs between jurisdictions. We do not guarantee that any Material qualifies for exclusive copyright protection or registration.
10.5. Rights in the Service itself, including software, interface, branding, design, templates and underlying technology, remain with us or the relevant rights holders and are not transferred to you.
11. Prohibited use
You must not use the Service to:
- create or distribute unlawful, threatening, harassing, defamatory or discriminatory content;
- harass, stalk, blackmail, deceive or unlawfully invade another person's privacy;
- infringe copyright, trademark, publicity, privacy, image, voice or other rights;
- impersonate a real person, clone or misuse a person's voice or likeness without the permissions required by law and by the relevant rights holder;
- mislead others into believing that a real person created, performed, endorsed or approved content when they did not;
- introduce malicious code, bypass technical restrictions or interfere with the operation or security of the Service;
- access the Service through unauthorized large-scale automation, scraping or abuse; or
- resell access to the Service or present the Service itself as your own product without written authorization.
We may restrict access, remove Materials or take other reasonable action where we reasonably believe these Terms, applicable law or third-party rights have been violated.
12. Refunds and technical issues
12.1. Refunds, duplicate charges, failed delivery and payment-related issues are handled in accordance with our Refund Policy, the Merchant of Record's applicable buyer terms, and mandatory consumer law.
12.2. For product-related support, contact mail@pesenkaspeta.com and include the email address used for the purchase, order or transaction identifier if available, purchase date and a description of the issue.
12.3. If payment succeeds but purchased digital content is not delivered because of a technical failure of the Service, we will take reasonable steps to restore access or re-deliver the content, and any refund entitlement will be handled under the Refund Policy, the Merchant of Record's buyer terms and applicable law.
12.4. Subjective dissatisfaction with a creative choice does not by itself establish a technical defect where the digital product was delivered as described, but this does not restrict any mandatory consumer right.
13. Storage and availability of purchased content
13.1. You are responsible for keeping downloaded MP3 files and other downloaded Materials.
13.2. Materials hosted by the Service may be retained for a limited period as described in the product interface, Privacy Policy or other notice provided to you.
13.3. Greeting Pages are not guaranteed to remain online indefinitely unless we expressly state otherwise.
13.4. Where lawful and technically reasonable, hosted Materials may eventually be deleted. You should download and save any Materials you want to retain.
14. Service availability and changes
14.1. We aim to keep the Service available but do not guarantee uninterrupted or error-free operation.
14.2. Availability may be affected by maintenance, updates, network failures, infrastructure providers, payment services or other third-party systems.
14.3. We may change the interface, available styles, technical limits, features and the contents of future Orders.
14.4. Changes to the Service do not affect rights that have already arisen from a completed Order except where required by law, security needs, third-party rights or technical necessity.
15. Liability
15.1. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, or any mandatory consumer right.
15.2. To the extent permitted by applicable law, we are not responsible for loss or claims resulting from inaccurate Input, your infringement of third-party rights, unauthorized sharing of access links, or use of Materials in violation of these Terms.
15.3. We are not responsible for the independent acts, outages or failures of banks, the Merchant of Record, communications providers, social networks, messaging platforms, hosting providers or other third parties, except to the extent liability cannot lawfully be excluded.
15.4. The Service is provided for personal use unless an Order expressly provides otherwise. Nothing in these Terms creates guarantees beyond those expressly stated or required by applicable law.
16. Privacy and personal data
16.1. Personal data is processed as described in our Privacy Policy and in accordance with applicable data protection law.
16.2. Where consent is required as a legal basis for a specific processing activity, we may request it separately.
16.3. Do not submit unnecessary sensitive information such as identity-document numbers, full payment-card details, medical information or other highly sensitive personal data that is not required to create a Song.
16.4. If you submit information about the recipient of a Song or another person, you are responsible for having a lawful basis or any required permission to provide that information.
17. Changes to these Terms
17.1. We may update these Terms when the Service, applicable law or our business processes change.
17.2. The current version will be published on this page with its latest update date.
17.3. Unless applicable law requires otherwise, an Order remains subject to the terms that applied when the purchase was completed.
18. Complaints, disputes and applicable law
18.1. Product-related complaints may be sent to mail@pesenkaspeta.com. Payment-related matters may also be handled by the Merchant of Record.
18.2. We may request information reasonably necessary to identify an Order and investigate a complaint.
18.3. These Terms do not deprive consumers of protections granted by mandatory law in their country or region of residence.
18.4. The law applicable to a purchase transaction may also be determined by the Merchant of Record's buyer terms. Nothing in these Terms requires a consumer to waive a forum, remedy or protection that cannot lawfully be waived.
