This Privacy Policy explains how Pesenka Speta, operated by Vladimir Vul (“we”, “us” or “Service Provider”), collects, uses, stores and shares personal data when you use pesenkaspeta.com and related services.

1. General

1.1. We are committed to processing personal data lawfully, fairly and transparently and to respecting applicable privacy and data protection rights.

1.2. This Policy applies to information we receive when you visit the website, create a Song, access your account or private links, complete a purchase, receive purchased Materials, use a Greeting Page or contact support.

1.3. Cookies and similar technologies may also be governed by a separate Cookie Policy or consent interface, where required by applicable law.

2. Key definitions

Personal Data means information relating to an identified or identifiable individual.

Processing means any operation performed on Personal Data, including collection, storage, organization, use, disclosure, transfer, restriction, deletion or destruction.

User means a visitor to the website or a person using the Service.

Service means the Pesenka Speta website and its functions for creating, purchasing, storing, accessing and sharing personalized Songs and Greeting Pages.

Merchant of Record means the authorized reseller that processes the purchase transaction, acts as the seller of record for that transaction and handles payment-related obligations under its own terms.

3. Privacy principles

We aim to follow these principles when processing Personal Data:

  • process data lawfully, fairly and transparently;
  • collect data for specific and legitimate purposes;
  • collect only data reasonably necessary for those purposes;
  • take reasonable steps to keep data accurate and up to date;
  • retain data only for as long as reasonably necessary or legally required; and
  • use appropriate technical and organizational measures to protect data.

4. Personal Data we collect and why

4.1. Account and access

We may process your email address, user or session identifiers, IP address, authentication events, access dates and records of acceptance of legal documents.

We use this information to create or maintain access, send sign-in links or service messages, protect accounts and links from misuse, and provide access to your Songs and purchased Materials.

4.2. Song creation and personalization

We process the information you submit for creating a personalized Song, which may include the recipient's name, occasion, relationship, musical style, wishes, personal details, memories and other text you choose to provide.

We use this information to create lyrics, music and other requested Materials and to provide the Service you requested.

4.3. Orders and payments

We may receive and process your email address, order identifier, transaction identifier, product information, selected Song or Variant, currency, amount, payment status, refund status and other transaction metadata supplied to us by the Merchant of Record.

We use this information to fulfill the Order, provide access to purchased Materials, prevent fraud, provide support, reconcile transactions and comply with legal obligations.

Payment card details and other full payment credentials are entered and processed by the Merchant of Record or its payment providers. We do not receive or store your full payment card number, card security code or equivalent complete payment credentials for transactions processed through the Merchant of Record.

4.4. Greeting Pages

A Greeting Page may contain the recipient's name, Song, message, design elements and images or other content submitted by the User.

A Greeting Page may be accessible to anyone who has its shareable link. You are responsible for deciding whom you share that link with and for having the necessary rights or permissions to include information about other people.

4.5. Support, security and service improvement

We may process your email address, support messages, IP address, browser and device information, pages visited, cookies, interface events, diagnostic information, logs and error reports.

We use this information to answer support requests, diagnose technical issues, prevent abuse and attacks, maintain security, measure Service performance and improve the Service.

5. How we collect Personal Data

We may collect Personal Data:

  • directly from you when you submit forms, create a Song, contact support or otherwise use the Service;
  • automatically through server logs, cookies, session technologies and similar technical mechanisms;
  • from the Merchant of Record in connection with purchases, refunds, disputes and transaction status; and
  • from service providers where necessary to operate, secure or troubleshoot the Service.

6. Legal bases for processing

Depending on your location and the processing activity, we may rely on one or more of the following legal bases:

  • performance of a contract or steps requested by you before entering into a contract;
  • your consent, where consent is required;
  • our legitimate interests, such as operating and securing the Service, preventing fraud, providing support and improving reliability, where those interests are not overridden by your rights;
  • compliance with legal obligations; and
  • establishment, exercise or defense of legal claims where applicable.

Where processing is based on consent, you may withdraw that consent at any time. Withdrawal does not affect processing that was lawful before withdrawal and does not necessarily require us to stop processing data where another lawful basis applies.

7. Service providers and data sharing

We do not sell Personal Data to data brokers or third-party advertising networks.

We may share Personal Data only where reasonably necessary with categories of recipients such as:

  • the Merchant of Record and payment-related providers for transaction processing, fraud prevention, refunds, disputes, receipts and related support;
  • hosting, database, storage, network and infrastructure providers;
  • email and transactional messaging providers;
  • AI and content-generation providers used to create requested lyrics, music or related Materials;
  • analytics, monitoring, security and technical-support providers; and
  • government authorities, regulators, courts or other parties where disclosure is required by applicable law or is reasonably necessary to protect legal rights.

Service providers receive only the information reasonably necessary for their role and process it under their applicable agreements, privacy terms and legal obligations.

Depending on the processing context, we and the Merchant of Record may each act as independent controllers of the Personal Data we process for our own respective purposes. The Merchant of Record's own privacy notice applies to data it collects and processes for the purchase transaction.

8. Artificial intelligence and automated processing

We use automated systems and artificial intelligence to create lyrics, music and other requested Materials. Information you provide for Song creation may be included in requests sent to AI or content-generation providers where necessary to produce the requested result.

You should avoid submitting unnecessary sensitive information in Song instructions or other free-text fields.

The Service does not use this creative processing to make decisions that produce legal or similarly significant effects about you, such as decisions about employment, creditworthiness, insurance or eligibility for public services.

9. Information about other people

If you provide Personal Data about a Song recipient or another person, you are responsible for ensuring that you have a lawful basis, consent or other permission where required to provide and use that information.

Do not submit highly sensitive information about another person unless it is genuinely necessary, lawful and appropriate for the requested Service.

10. Data retention

We retain Personal Data only for as long as reasonably necessary for the purposes described in this Policy, including providing the Service, maintaining security, resolving disputes and meeting legal obligations.

Current operational retention periods may include:

  • temporary sign-in links or similar authentication records: approximately 15 minutes where technically applicable;
  • authenticated sessions: up to 30 days, unless ended earlier;
  • unfinished Song drafts: up to 90 days from the last relevant activity, unless otherwise stated in the Service;
  • Order, transaction and purchased-content records: for as long as needed to fulfill the Order, provide access, handle support or disputes, and satisfy applicable legal requirements; and
  • support communications and technical logs: for as long as reasonably necessary for support, security, fraud prevention and dispute resolution.

When Personal Data is no longer required, we may delete, anonymize or securely dispose of it, subject to legal, technical and backup-retention requirements.

11. International data transfers

The Service is intended for an international audience and may use service providers located in different countries. As a result, Personal Data may be processed outside your country of residence.

Where applicable data protection law requires safeguards for an international transfer, we take reasonable steps to use an appropriate legal mechanism, such as adequacy decisions, contractual safeguards or other recognized transfer mechanisms.

12. Your privacy rights

Depending on where you live, you may have some or all of the following rights:

  • to request access to Personal Data we hold about you;
  • to request correction of inaccurate or incomplete Personal Data;
  • to request deletion of Personal Data, subject to applicable exceptions;
  • to request restriction of certain processing;
  • to object to certain processing based on legitimate interests or direct marketing;
  • to withdraw consent where processing is based on consent;
  • to request portability of certain Personal Data where applicable;
  • to opt out of certain forms of sale, sharing or targeted advertising where applicable; and
  • to complain to an applicable data protection authority.

To exercise a privacy right relating to data controlled by us, contact mail@pesenkaspeta.com. We may need to verify your identity before completing a request.

Some payment-related Personal Data is controlled independently by the Merchant of Record. Requests concerning data held solely by the Merchant of Record may need to be directed to it through the contact methods provided in its privacy notice or checkout materials.

13. Cookies and similar technologies

The Service may use cookies, local storage and similar technologies for authentication, security, preferences, diagnostics and analytics.

Where required by applicable law, non-essential cookies or similar technologies are used only after the required consent has been obtained. You may be able to manage those choices through the cookie banner or browser settings.

14. Security

We use reasonable technical and organizational safeguards intended to protect Personal Data against unauthorized access, alteration, disclosure, loss or destruction.

Measures may include access controls, encrypted network connections, protected service credentials, backups, monitoring and other safeguards appropriate to the nature of the Service.

No online service can guarantee absolute security. If we become aware of a Personal Data breach, we will take reasonable steps to investigate, mitigate the impact and provide notifications where required by applicable law.

15. Children

Purchases are intended for adults who have reached the age of legal majority in their jurisdiction. The Service is not intended to knowingly collect Personal Data directly from children where parental or guardian authorization is legally required and has not been provided.

If you believe a child has provided Personal Data to us in violation of applicable law, contact us so we can review the situation.

16. Changes to this Policy

We may update this Privacy Policy to reflect changes in the Service, our providers, our processing practices or applicable law.

The current version will be published on this page with the date of the latest update.
